Our client and her family visited the beach resort in April 2019 for a spring break vacation. When our client was trying to enter an elevator on the property, the door rapidly closed on her body, pinching her and causing her shoulder to pop out-of-socket. Our client underwent labral repair surgery after weeks of pain and discomfort. More than a year following the accident, our client was still dealing with discomfort and limited range of motion.
As part of the litigation, our personal injury partners, Justin Osborn and Seth Beckley, argued that the door protection systems installed on the resort elevators were insufficient and incorrect for use in a humid, beach environment. They also argued that the resort had inadequate safety and maintenance policies and training. Our investigation revealed that the head of the resort’s maintenance staff had no prior training or experience with elevator maintenance or operation.
