In 2020, we represented clients in legal malpractice and fraud claims against a family member and lawyer who defrauded them of their share of property that they all jointed inherited, and our team of legal malpractice lawyers in Raleigh obtained a judgment in our clients’ favor for $340,338.27.
The Defendant is an attorney in Franklin County. In 2016 she and our clients each inherited a one-third share in real property located in Henderson, North Carolina. Defendant proposed to buy our clients’ shares and drafted written contracts that all parties signed. Our clients relied on the Defendant to deal fairly with them since she is an attorney, and Defendant induced our clients to execute a deed in her favor, without paying either one the contract price. Then she strung them along for almost three years with promises of imminent payment, until our clients finally engaged our team of Raleigh malpractice lawyers and filed suit shortly before applicable statutes of limitations would have expired.
Our malpractice team in Raleigh moved for summary judgment and entry of default judgment, which the Court granted. We argued that double damages were applicable based on NCGS section 84-13 which provides for double damages when an attorney commits a fraudulent act or practice. The Court agreed and ordered, "Defendant's actions were an intentional fraud upon the Plaintiffs by and through her status as an attorney." The total judgment is for $340,338.27.
